Providence Healthcare Network (“PHN”) is pleased to offer you information via a Web-based version of our computer systems called MyChart. We think it is important for you to know how we handle information we communicate via the Internet. This Terms & Conditions statement outlines our practices and our sensitivity to your right to privacy.

We reserve the right to revoke access to MyChart or to revise these Terms and Conditions at any time for any reason. It is your responsibility to review these terms and conditions, and by continuing to use MyChart, you consent to any changes to the Terms and Conditions.

The information provided on MyChart is not a substitute for the advice of your personal physician or other qualified health-care professional. Always seek the advice of your physician or other qualified health-care professional with any questions you may have regarding medical symptoms or a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on MyChart. Minor Eligibility - You must be age 18 or older to request a personal account.

Proxy Access - Individuals age 18 or older may request proxy access to another individual’s MyChart account by submitting a request at the Providence Health Network Medical Release of Information Office. Such access will only be granted to parties with parental rights or legal guardianship, or signed approval of the MyChart account holder and only to the extent that the party requesting proxy access can demonstrate the legal right to account holder's medical information. A MyChart account will be activated /enabled for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes, the proxy must inform Providence Health Network (PHN) immediately by calling Providence Medical Release of Information office at 254-751-4715. PHN reserves the right to revoke proxy access at any time for any reason.

E-mail Privacy - Users of MyChart should be aware that they will be notified via e-mail when there is new medical information to be viewed on MyChart. Users must be aware that any person with access to a user’s e-mail will be able to see this notification. This could include the patient’s spouse, employer or anyone else that can access a patient’s e-mail account. Although no private medical information will be sent, the notification that new medical information is available by accessing MyChart may be information that a patient would not want others to know. Thus, patients should take this into account when providing an e-mail address.

Security and Confidentiality - We afford the same degree of confidentiality to medical information stored on MyChart as is given to medical information stored by PHN in any other medium. PHN is committed to protecting the confidentiality of your medical information. We limit PHN employees’ access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time you access MyChart.

We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use. Due to the nature of the Internet and on-line communications, however, we cannot guarantee that any information transmitted on-line will remain absolutely confidential, and we are not liable for the illegal acts of third parties such as criminal hackers. Please refer to our Privacy Policy for further explanation.

For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to Providence Health Center by viewing the digital certificate. This certificate verifies the connection between the Providence Health Center server's public key and the server's identification.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet. As a MyChart user, your role in maintaining the security of your medical information is: 1) Changing your password on a regular basis, and 2) Keeping your login ID and password confidential.

Restrictions on Use and Ownership - All pages herein and any material made available for download are the property of PHN. The content is provided for PHN and its patients only. All trademarks, service marks, and logos used, including but not limited to MyChart and Epic, are the trademarks, service marks, or logos of their respective owners. Nothing on this website should be construed as granting any license or right to use any trademark, service mark, or logo displayed on this website without the express permission of PHN or the third party that may own the trademark, service mark, or logo.

Indemnification - You agree to indemnify PHN and any of our or their successors, assigns or licensees, together with our and their respective officers, directors, employees and agents, against any damages, losses, liabilities, judgments, costs or expenses (including reasonable attorney's fees and costs and all other fees and costs of defense) arising out of (a) a claim by a third party relating to your use of MyChart, or (b) your breach or violation of these Terms and Conditions.

No Warranties

THIS WEBSITE, MYCHART AND THE CONTENT CONTAINED THEREIN ARE PROVIDED BY PHN ON AN "AS IS" BASIS. PHN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF ITS WEB SITE, MYCHART OR THE CONTENT, PRODUCTS AND/OR SERVICES INCLUDED THEREIN. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, PHN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES, WORKMANLIKE EFFORT, TITLE AND/OR INFRINGEMENT.
